1. About DrillTime١. نبذة عن تطبيق Drill Time

DrillTime is a metronome, speed trainer, and rhythm-training app for musicians and music students. Drill Time هو تطبيق مترونوم للتدريب السرعة والإيقاع، مخصص للموسيقيين وطلاب الموسيقى.

The app is designed to work fully offline. It has:صُمّم التطبيق ليعمل بالكامل دون اتصال بالإنترنت، ويتميّز بما يلي:

• no subscriptionلا يتطلب اشتراكاً
• no user accountsلا يتطلب إنشاء حسابات مستخدمين
• no advertisingلا يتضمن أي إعلانات
• no in-app purchasesلا يتضمن أي عمليات شراء داخل التطبيق
• no requirement to connect to an online serviceلا يتطلب الاتصال بأي خدمة عبر الإنترنت.

The app is purchased once through the Apple App Store. يُشترى التطبيق مرة واحدة عبر متجر تطبيقات آبل (Apple App Store).

2. Licence to Use the App٢. ترخيص استخدام التطبيق

Your purchase gives you a limited, non-exclusive, non-transferable licence to use DrillTime on compatible Apple devices that you own or control, subject to Apple's Standard EULA and App Store Usage Rules. يمنحك شراء التطبيق ترخيصًا محدودًا وغير حصري وغير قابل للتحويل لاستخدام Drill Time على أجهزة آبل (Apple) المتوافقة التي تملكها أو تتحكم بها، وذلك وفقًا لاتفاقية آبل (Apple) القياسية لترخيص المستخدم النهائي وقواعد استخدام متجر التطبيقات (App Store).

Schools and other organisations may install and use the app according to Apple's applicable purchasing, device-management, and institutional deployment terms. يجوز للمدارس والمؤسسات الأخرى تثبيت التطبيق واستخدامه وفقًا لشروط آبل (Apple) المعمول بها الخاصة بالشراء وإدارة الأجهزة والنشر المؤسسي.

Purchasing or downloading the app does not transfer ownership of the app or its intellectual property to you. لا يعني شراء التطبيق أو تنزيله نقل ملكية التطبيق أو ملكيته الفكرية إليك.

Because the app is distributed through the App Store, you also acknowledge the following: ولأن التطبيق يُوزَّع عبر متجر التطبيقات (App Store)، فإنك تقرّ أيضًا بما يلي:

• These terms are between you and the developer only, not Apple. Apple is not responsible for the app or its content.تُبرم هذه الشروط بينك وبين مطوّر التطبيق فقط، ولا تُعد آبل (Apple) طرفاً فيها. ولا تتحمل آبل (Apple) أي مسؤولية عن التطبيق أو محتواه.
• Apple has no obligation whatsoever to furnish any maintenance and support services with respect to the app.لا تتحمل آبل (Apple) أي التزام على الإطلاق بتقديم أي خدمات صيانة أو دعم فيما يتعلق بالتطبيق.
• If the app fails to conform to any applicable warranty, you may notify Apple and Apple will refund the purchase price. To the maximum extent permitted by law, Apple has no other warranty obligation for the app.إذا لم يتوافق التطبيق مع أي ضمان معمول به، يجوز لك إخطار آبل (Apple) وستقوم بردّ ثمن الشراء. وإلى أقصى حد يسمح به القانون، لا تتحمل آبل أي التزام ضمان آخر تجاه التطبيق.
• The developer, not Apple, is responsible for addressing any claims relating to the app, including product liability claims, claims that the app fails to conform to legal or regulatory requirements, and consumer protection claims.يتحمل مطوّر التطبيق، وليس آبل (Apple)، مسؤولية التعامل مع أي مطالبات تتعلق بالتطبيق، بما في ذلك مطالبات المسؤولية عن المنتج، أو المطالبات المتعلقة بعدم امتثال التطبيق للمتطلبات القانونية أو التنظيمية، أو مطالبات حماية المستهلك.
• In the event of any third-party claim that the app infringes intellectual property rights, the developer, not Apple, is responsible for the investigation, defence, settlement, and discharge of that claim.في حال وجود أي مطالبة من طرف ثالث بأن التطبيق ينتهك حقوق الملكية الفكرية، فإن المطوّر، وليس آبل (Apple)، هو المسؤول عن التحقيق والدفاع والتسوية وإبراء الذمة بشأن تلك المطالبة.
• Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you.تُعدّ آبل (Apple) والشركات التابعة لها طرفًا ثالثًا مستفيدًا من هذه الشروط، ويحق لها إنفاذها بحقك.

3. Intellectual Property٣. الملكية الفكرية

DrillTime's original software, design, interface, graphics, written content, audio content, branding, and other original materials are owned or licensed by the developer and are protected by applicable intellectual property laws. إن البرمجيات الأصلية والتصميم وواجهة المستخدم والرسومات والمحتوى المكتوب والمحتوى الصوتي والهوية التجارية وسائر المواد الأصلية الخاصة بتطبيق Drill Time مملوكة لمطوّر التطبيق أو مُرخَّص له باستخدامها، وهي محمية بموجب قوانين الملكية الفكرية المعمول بها.

Third-party fonts, symbols, software components, audio materials, and other resources remain the property of their respective owners and are used under their applicable licences. تظل الخطوط، والرموز ومكوّنات البرمجيات والمواد الصوتية وغيرها من الموارد التابعة لجهات خارجية، ملكاً لأصحابها، وتُستخدم وفقاً للتراخيص المطبقة عليها.

"DrillTime", its logo, and its associated branding may not be used in a way that suggests endorsement, ownership, or affiliation without written permission. لا يجوز استخدام اسم "Drill Time/DrillTime" وشعاره وهويته التجارية بأي طريقة توحي بوجود تأييد أو ملكية أو ارتباط، ما لم يصدر إذن كتابي بذلك.

4. Acceptable Use٤. الاستخدام المقبول

You must use DrillTime lawfully and for its intended musical, educational, and practice-related purposes. يجب استخدام Drill Time بصورة مشروعة، وللأغراض الموسيقية والتعليمية والتدريبية التي صُمم من أجلها.

Except where permitted by applicable law or an applicable open-source licence, you must not: وباستثناء ما يسمح به القانون المعمول به أو ترخيص مفتوح المصدر معمول به، لا يجوز لك:

• copy, redistribute, sell, rent, sublicense, or commercially exploit the appنسخ التطبيق أو إعادة توزيعه أو بيعه أو تأجيره أو ترخيصه من الباطن أو استغلاله تجاريًا
• reverse-engineer, decompile, disassemble, or attempt to obtain its source codeإجراء هندسة عكسية للتطبيق أو تفكيكه أو محاولة الحصول على شفرته المصدرية
• modify the app or create an unauthorised derivative versionتعديل التطبيق أو إنشاء نسخة مشتقة غير مصرّح بها
• bypass security, licensing, or technical restrictionsتجاوز القيود الأمنية أو الترخيصية أو التقنية
• use the app in a way that infringes another person's rightsاستخدام التطبيق بطريقة تنتهك حقوق أي شخص آخر
• use the app in violation of any applicable lawاستخدام التطبيق بما يخالف أي قانون معمول به

5. Purchases and Refunds٥. المشتريات واسترداد الأموال

Purchases, billing, payment processing, and purchase records are managed by Apple through the App Store. تتولى آبل (Apple) إدارة عمليات الشراء والفوترة ومعالجة المدفوعات وسجلات الشراء عبر متجر التطبيقات (App Store).

Refund requests must be submitted to Apple and are assessed under Apple's refund procedures and any applicable consumer laws. The developer cannot directly process an App Store refund. تُقدَّم طلبات استرداد الأموال إلى آبل (Apple) وتُقيَّم وفق استرداد الأموال المعتمدة لدى آبل (Apple) وأي قوانين معمول بها لحماية المستهلك. ولا يستطيع المطوّر معالجة طلبات استرداد الأموال الخاصة بمشتريات متجر التطبيقات (App Store) مباشرةً.

6. Privacy and Data٦. الخصوصية والبيانات

DrillTime does not require an account. لا يتطلب Drill Time إنشاء حساب.

The app itself does not collect, store, sell, share, or transmit personal information, as explained in the DrillTime Privacy Policy. لا يجمع التطبيق نفسه أي معلومات شخصية ولا يخزّنها ولا يبيعها ولا يشاركها ولا يرسلها، كما هو موضّح في سياسة خصوصية وقت التمرين.

Apple may process information associated with App Store purchases, downloads, devices, diagnostics, or use of Apple services under Apple's own terms and privacy policy. This processing is controlled by Apple rather than DrillTime. قد تعالج آبل (Apple) المعلومات المرتبطة بعمليات الشراء أو التنزيل من متجر التطبيقات (App Store) أو بالأجهزة أو ببيانات التشخيص أو باستخدام خدمات آبل (Apple)، بموجب شروطها وسياسة الخصوصية الخاصة بها. وتتحكم آبل (Apple) في هذه المعالجة، وليس Drill Time.

7. Children and Educational Use٧. الأطفال والاستخدام التعليمي

DrillTime is suitable for general musical and educational use, including use by students and on shared school devices. Drill Time مناسب للاستخدام الموسيقي والتعليمي العام، بما في ذلك استخدامه من قِبل الطلاب وعلى الأجهزة المدرسية المشتركة.

Parents, guardians, teachers, and schools remain responsible for supervising younger users and deciding whether the app and its settings are appropriate for them. يظل الآباء والأوصياء والمعلمون والمدارس مسؤولين عن الإشراف على المستخدمين من صغار السن، وتحديد مدى ملاءمة التطبيق وإعداداته لهم.

The app does not include social features, direct messaging, user-generated content, advertising, or account registration. لا يتضمّن التطبيق ميزات اجتماعية أو مراسلة مباشرة أو محتوى من إنشاء المستخدمين أو إعلانات أو تسجيل حسابات.

8. Sound and Flashing-Light Safety٨. سلامة الصوت والأضواء الوامضة

DrillTime can produce repeated sounds and visual flashes. قد يُصدر Drill Time أصواتاً متكررة وومضات بصرية.

Use a safe device and headphone volume. Prolonged exposure to loud audio may damage hearing. استخدم مستوى صوت آمنًا للجهاز والسماعات. قد يؤدي التعرّض المطوّل للصوت العالي إلى الإضرار بالسمع.

People who are sensitive to flashing lights or who have photosensitive epilepsy should disable visual flashing features or avoid using them. Parents, teachers, and guardians should supervise these settings when the app is used by children. على الأشخاص الحساسين للأضواء الوامضة أو المصابين بالصرع الحسّاس للضوء تعطيل ميزات الوميض البصري أو تجنّب استخدامها. وينبغي للآباء والمعلمين والأوصياء الإشراف على هذه الإعدادات عند استخدام الأطفال للتطبيق.

9. Accuracy and Intended Purpose٩. الدقة والغرض المقصود

DrillTime is intended for musical practice, teaching, and general rhythm training. Drill Time مخصص للتدريب الموسيقي والتعليم والتدريب العام على الإيقاع.

We aim to provide accurate and reliable timing, but performance may be affected by the device, operating system, wireless audio equipment, connected hardware, power-saving settings, or other technical conditions. نسعى إلى تقديم توقيت دقيق وموثوق، إلا أن الأداء قد يتأثر بالجهاز أو نظام التشغيل أو معدات الصوت اللاسلكية أو الأجهزة المتصلة أو إعدادات توفير الطاقة أو غيرها من الظروف التقنية.

The app must not be relied upon for medical, emergency, scientific, industrial, transport, or other safety-critical timing purposes. لا يجوز الاعتماد على التطبيق لأغراض التوقيت في المجالات الطبية، أو حالات الطوارئ، أو التطبيقات العلمية أو الصناعية، أو وسائل النقل، أو أي استخدامات أخرى تتطلب توقيتاً بالغ الأهمية للسلامة.

10. Device Compatibility and Updates١٠. توافق الأجهزة والتحديثات

DrillTime requires a compatible device and operating-system version. يتطلب Drill Time جهازاً متوافقاً وإصداراً متوافقاً من نظام التشغيل.

We may release updates that change, improve, remove, or replace features. We do not guarantee that the app will remain compatible with every future device or operating-system version. يجوز لنا إصدار تحديثات تُغيّر ميزات التطبيق أو تُحسّنها أو تزيلها أو تستبدلها. ولا نضمن استمرار توافق التطبيق مع جميع الأجهزة أو إصدارات أنظمة التشغيل المستقبلية.

We may stop offering new downloads, updates, or technical support for the app. Where technically possible, an existing installed copy may continue to operate, but continued operation is not guaranteed. يجوز لنا التوقف عن توفير تنزيلات جديدة للتطبيق، أو تحديثاته، أو الدعم الفني للتطبيق. وحيثما أمكن ذلك تقنياً، فقد تستمر النسخة المثبتة الحالية من التطبيق في العمل، إلا أننا لا نضمن استمرار عملها.

11. Consumer Rights and Warranties١١. حقوق المستهلك والضمانات

Nothing in these terms excludes, restricts, or modifies any consumer guarantee, statutory right, remedy, or liability that cannot legally be excluded or limited. لم يرد هذه الشروط ما يستبعد أو يقيّد أو يعدّل أي ضمان للمستهلك أو حق قانوني أو تعويض أو مسؤولية لا يجوز استبعادها أو تقييدها بموجب القانون.

Subject to those rights, DrillTime is provided on an "as is" and "as available" basis. We do not guarantee that the app will always be uninterrupted, completely error-free, or compatible with every device, accessory, or audio configuration. ومع مراعاة تلك الحقوق، يُقدَّم Drill Time "كما هو" و"حسب توفره". ولا نضمن أن يعمل التطبيق دائماً دون انقطاع، أو أن يكون خالياً تماماً من الأخطاء، أو متوافقاً مع جميع الأجهزة أو الملحقات أو إعدادات الصوت.

12. Limitation of Liability١٢. حدود المسؤولية القانونية

To the maximum extent permitted by law, the developer will not be liable for indirect, incidental, special, or consequential losses resulting from the use of, or inability to use, DrillTime. إلى أقصى حد يسمح به القانون، لا يتحمل المطوّر المسؤولية عن أي خسائر غير مباشرة أو عرضية أو خاصة أو تبعية ناتجة عن استخدام Drill Time أو تعذّر استخدامه.

Where liability can legally be limited, the developer's total liability relating to the app will not exceed the amount paid for the app. وحيثما جاز قانونًا تحديد المسؤولية، لن تتجاوز المسؤولية الإجمالية للمطوّر فيما يتعلق بالتطبيق المبلغ المدفوع مقابل التطبيق.

This section does not limit liability that cannot legally be excluded or limited, including liability arising from fraud, deliberate misconduct, or any non-excludable consumer right. لا يحدّ هذا البند من المسؤولية التي لا يجوز قانونًا استبعادها أو تقييدها، بما في ذلك المسؤولية الناشئة عن الاحتيال أو سوء السلوك المتعمّد أو أي حق مستهلك غير قابل للاستبعاد.

13. Termination١٣. إنهاء الترخيص

Your licence to use DrillTime may terminate automatically if you materially violate these terms or Apple's applicable licence terms. قد ينتهي ترخيصك لاستخدام Drill Time تلقائياً إذا انتهكت هذه الشروط أو شروط ترخيص آبل (Apple) المعمول بها انتهاكاً جوهرياً.

If your licence terminates, you must stop using and delete the app. وإذا انتهى ترخيصك، فعليك التوقف عن استخدام التطبيق وحذفه.

14. Governing Law١٤. القانون الحاكم

These terms are governed by the laws of the United Arab Emirates. تخضع هذه الشروط لقوانين دولة الإمارات العربية المتحدة.

The courts of Dubai, United Arab Emirates will have non-exclusive jurisdiction over disputes relating to these terms. وتختص محاكم دبي بدولة الإمارات العربية المتحدة اختصاصًا غير حصري بالنظر في النزاعات المتعلقة بهذه الشروط.

To the extent permitted by the law that applies to you, any dispute between you and the developer will be resolved on an individual basis. You waive any right to bring or participate in a class action, collective action, or representative proceeding. This waiver does not apply where it is prohibited by law, and it does not remove any mandatory consumer right. إلى الحد الذي يسمح به القانون المعمول به في حقك، يُحل أي نزاع بينك وبين المطوّر على أساس فردي. وتتنازل عن أي حق في رفع دعوى جماعية أو تمثيلية أو المشاركة فيها. ولا يسري هذا التنازل حيثما يحظره القانون، ولا يُلغي أي حق إلزامي من حقوق المستهلك.

Nothing in this section removes any mandatory consumer protection or legal right that applies to you in your country of residence. لا شيء في هذا البند يلغي أي حماية إلزامية للمستهلك أو حق قانوني يسري عليك في بلد إقامتك.

15. Severability١٥. استقلالية البنود

If any part of these terms is found to be invalid or unenforceable, that part will be limited or removed only to the minimum extent necessary. The remaining terms will continue to apply. إذا تبيّن أن أي جزء من هذه الشروط غير صالح أو غير قابل للإنفاذ، فسيُقيَّد ذلك الجزء أو يُحذف بالقدر الأدنى اللازم فقط، وتظل بقية الشروط سارية المفعول.

16. Changes to These Terms١٦. التعديلات على هذه الشروط

We may update these terms when the app, our business, or applicable legal requirements change. يجوز لنا تحديث هذه الشروط عند حدوث تغييرات في التطبيق أو في أعمالنا أو في المتطلبات القانونية السارية.

The latest version, with its effective date, will always be available on the DrillTime website. Because the app works fully offline, updated terms are delivered with new versions of the app: by downloading or updating to a new version, you accept the terms that apply to that version. يظل أحدث إصدار، متضمناً تاريخ سريانه، متاحاً دائماً على الموقع الإلكتروني لتطبيق Drill Time. ونظراً إلى أن التطبيق يعمل بالكامل دون اتصال بالإنترنت، فإن الشروط المحدَّثة تُقدَّم مع الإصدارات الجديدة من التطبيق. ويُعد تنزيل إصدار جديد أو تحديث التطبيق موافقةً منك على الشروط السارية على ذلك الإصدار.

If you do not agree with updated terms, do not download the updated version. You may continue using your existing installed version under the terms that applied to it, or stop using the app. إذا لم توافق على الشروط المحدَّثة، فلا تنزّل الإصدار المحدَّث. ويجوز لك الاستمرار في استخدام الإصدار المثبّت لديك وفقاً للشروط التي كانت سارية عليه، أو التوقف عن استخدام التطبيق.
